Terms & Conditions

 

General Terms

These terms and conditions apply to any individual or business who uses Miller's Lawn Care as their service provider. If the terms and conditions change during the year, customers will be notified of the changes. Customers who are on a contract will be held to the contract terms, and not necessarily the terms and conditions posted here.

 

Property Accessibility

Locked gates must remain unlocked for the full day of your scheduled service. The customer may instead provide Miller's Lawn Care with a key or code to gain access to the property. Miller's Lawn Care will make their best effort to close gates securely when they are done servicing the property, but it is the customer’s responsibility to ensure the gate is closed. Miller's Lawn Care will not be responsible for pets, kids, or items that are lost or stolen as a result of a gate not being secured.

 

It is the customer’s responsibility to ensure all items in the serviceable work area are picked up by the date of service, including pet droppings, pet leashes, toys, bones, hoses, cords, and similar objects.

 

If part of a customer's property is inaccessible, due to a locked gate, construction project, or similar situation, the customer will be billed the greater amount of the $20.00 trip charge or a prorated amount for the portion of the completed service.

 

Lawn Mowing

Miller's Lawn Care will mow all turf areas with equipment that seems to the best fit for the property, including any combination of zero turn mowers, tractors, walk behind mowers, push mowers, string trimmers, and edging equipment.  Miller's Lawn Care offers services to be completed weekly, every other week, or rough cut on an extended term and all pricing will fluctuate accordingly. Miller's Lawn Care highly recommends mowing to be completed on a weekly basis and will disperse clippings so as not to be seen within a 24-hour period. If mowing is to be completed on every other week or on a longer basis, clippings will still be dispersed in the turf as cleanly as possible. Customers will be charged a double cut for lawns that are over 6 inches tall, and a triple cut for lawns that are over 12 inches tall. Mowing can be changed from weekly to every other week, and vice versa, by contacting Miller's Lawn Care.

 

Miller's Lawn Care will disperse clippings from the chute with care or use an operator chute discharge to control the flow of clippings while the lawn is being mowed. Once mowing has been completed, clippings, leaves, dust, and other debris will be blown off from hard surfaces and into the lawn. Miller's Lawn Care will not be held responsible for washing cars, houses, and other objects that may become dirty as a result of the property being mowed.

 

Grass and weeds in landscape beds will not be mowed or trimmed, because they should be sprayed with pesticides and physically pulled to eliminate weekly maintenance of the same weed. Maintaining grass and weeds in landscape beds is a fertilization and weed control service, not mowing. Turf areas that can’t be mowed will be trimmed with string line trimmers. It is the customer’s responsibility to protect trees, pots, plants, mailbox posts, sided areas of the house, fences, decks, playground equipment, downspout drains, air conditioning/heat pump systems, and similar objects with mulched landscape beds, so damage from a string trimmer can be prevented. Miller's Lawn Care will not be held responsible for damage done by mowers, trimmers, and edgers to items left in turf areas, including hoses, exposed utility lines, electrical cords, Invisible fence wiring, Christmas lights, landscape lighting, pet leashes, exposed irrigation heads, irrigation lines next to concrete flatwork, portable swimming pools, toys, and other similar objects. Miller's Lawn Care will provide reasonable care when mowing and trimming around the property, but will not be held responsible in the event damage occurs.

 

Picking up limbs is an additional service, and if the limbs are small, they will be mowed over.  If the limbs are too large to mow, they will be moved off to the side.  If the limbs are too large to move, they will be left and the area will be mowed around the limbs.

 

Trash will be picked up prior to mowing. In the event trash has been mowed over, the operator will pick up the trash to the best of their ability.

 

Miller's Lawn Care will not move objects in turf areas to mow under them, including BBQ grills, trampolines, hoses, hose reels, swings, toys, and similar objects.

 

It is the customer’s responsibility to pick up pet droppings prior to the scheduled mowing. Excessive droppings in the yard may be subject to a $10.00 inconvenience charge.

 

If the customer's property has an area that has standing water or is too wet to mow, that area will be skipped.  During the next regularly scheduled visit, the wet area will be reevaluated and either mowed/trimmed or skipped.  This will continue until the area is dry enough to mow.  Service will not be prorated for any visit that has an area too wet since it frequently takes just as long to mow/trim around the area.  Additionally, when the area is dry enough, it frequently needs to be cut multiple times.  During the summer, service will continue normally, even due to a lack of rain, and it is the customer’s responsibility to contact Miller's Lawn Care to change the regular service interval. Customers have different perceptions on when a lawn should be cut, and under no circumstances will Miller's Lawn Care make the judgment call.

 

Mulch

Miller's Lawn Care will normally prepare the landscape bed by spraying and/or pulling weeds, redefining the bed edge, applying weed pre-emergent, and installing mulch. New or neglected landscape beds will have mulch installed around two inches thick. Regularly serviced landscape beds will have mulch installed around one inch thick. Mulch will not be installed when ground conditions are wet or rain is expected within 24 hours after installation. Miller's Lawn Care will not warranty a length of time the mulch will retain its color or how long a newly mulched landscape bed will be free of weeds.

 

Landscape Installation

Miller's Lawn Care will install all hardscapes within industry standards, paying particular attention to creating a suitable base for the project. Plants will be installed with appropriate location, spacing, and depth. It is the customer’s responsibility to water the plants as appropriate. If Miller's Lawn Care is able to show the plant died from a lack of water, warranty submissions will be rejected.

 

Pruning

Miller's Lawn Care will prune trees and shrubs, using appropriate equipment and methods for the health of the plant. If the customer gives specific pruning instructions, to cut a tree or a plant far beyond a normal trim, Miller's Lawn Care will not be responsible in the event that tree or plant, fails to grow back or dies.

 

Turf Renovation

Miller's Lawn Care will call utilities to be marked for performing a lawn core aeration. Miller's Lawn Care will not be responsible for damage to any underground lines, including but not limited to, cable lines, phone lines, irrigation heads/pipes, Invisible fences, and similar items. It is the customer’s responsibility to mark irrigation heads prior to the aeration being performed, with white flags or other items that clearly mark the area.

Miller's Lawn Care can provide overseeding to aerated areas or new seeding for bare ground. Miller's Lawn Care uses some of the best seed in the industry, and germination failure is most likely due to lack of water by the customer. Miller's Lawn Care offers no seeding warranty due to our inability to control watering.

 

Spring and Fall Leaf Cleanup

Miller's Lawn Care will remove leaves from all hard surfaces, landscape beds, and turf areas to the best of our ability. We strive to pick up/mulch 95% of the leaves, but wet leaves, fruit, nuts, seeds, and leaves caught in thorny bushes may not be able to be entirely removed from the property. Miller's Lawn Care will not pick up an area a second time due to the wind blowing leaves from a neighboring property, and offers no guarantee to the length of time the property will be free of leaves.

 

Payment Terms

Regular serviced residential accounts will be billed Net 15, and service will be interrupted 15 days after the due date for non-payment. Regular serviced commercial accounts will be billed Net 30, and service will be interrupted 30 days after the due date for non-payment. One-time customers will be required to pay upon completion. Payments can be accepted at time of scheduled service.

Miller's Lawn Care accepts check(s) and cash only. Check payments can be mailed to Miller's Lawn Care, 8795 N Frontage Ln, Bridgeport, IL 62417. All check(s) are to be made payable to James Miller.

 

Customers must notify Miller's Lawn Care 48 hours prior to the service being performed, that they want their scheduled service skipped, or be subject to a $20.00 trip charge. If service has begun, and the customer stops Miller's Lawn Care from completing the service, the greater amount of $20.00 or the prorated amount will be charged.

 

Service Continuation

Miller's Lawn Care provides recurring services that automatically renew each year unless the service was a one-time event. Services are scheduled to be performed Monday through Friday, from 7:00A to 6:30P, but can vary due to national holidays and weather delays. In the event of a national holiday or rainy day, service will be delayed by one day. If there are two rain days, service will be delayed by two days, and so on.   

 

Service issues, including property damage, should be notified to Miller's Lawn Care within 48 hours after the service has been performed, or service will be considered acceptable. Miller's Lawn Care will make a reasonable attempt to correct any service issues, within 24 hours or the next business day. Problems with the service do not entitle anyone to nonpayment.

 

Customers, not under contract, may cancel service at any time by providing Miller's Lawn Care with written cancellation,  we ask that you give us 7-10 days notice of when you would like your scheduled services to come to an end, not the day before your scheduled service date. Therefore we will not accept cancellations made by either text messages or calls. If you call we will require a written cancellation and continue with scheduled services until we have received the written cancellation. Miller's Lawn Care reserves the right to refuse service to anyone at any time for any reason.

At Miller's Lawn Care, we offer a variety of special offers and discounts to those who are in need of experienced lawn care. We have something for everyone, both new and existing customers. Our goal as lawn service technicians in the Lawrence County area is to provide each client with the most optimal service available at a reasonable price. Below is a summary of our current specials: 

 

Current Clients: You can receive credit towards your account by referring Miller's Lawn Care to friends and family, here's how. If they join you as a Miller's Lawn Care client you receive $10 credit towards your account with Miller's Lawn Care. 

 

'Refer A Friend' New Client: If you were referred by a friend or family let Miller's Lawn Care know and not only will they receive a $10 credit but you as well will receive a credit of equal amount towards your account.
